When an injury occurs on the job you may have two potential claims. The first claim will seek to recover all available benefits in accordance with the Worker's Compensation Statute; unfortunately that Statute does not allow recovery for pain and suffering. The second claim will be to bring a personal injury claim against every negligent party; this will allow for recovery of pain and suffering and other damages not covered in the Worker's Compensation Statute.
The workers compensation laws are complex but rest assured we will explain everything to you as part of protecting your rights. For example, there is a four year statute of limitations to file a workers' compensation claim in Massachusetts. However, there are shorter time limits for certain types of claims. To receive compensation for lost wages you must be out of work for five or more days. If you are out of work for twenty-one or more days you may be able to receive disability benefits equaling sixty percent of your average weekly wage for up to three years. After those three years are up if you are not permanently disabled, your benefits will then be reduced. Also, insurance companies have one hundred and eighty days to pay an employee for damages without formally accepting responsibility for your injury. This is called "payment without prejudice."
