Premises Liability

Premises liability refers to injuries that occur on another person's property due to some type of dangerous condition. In Massachusetts and Rhode Island, the property owner may be liable to the injured person if they were negligent in maintaining the property or warning visitors against possible dangers. The classic premises liability case is the slip and fall, where an individual is injured by slipping or tripping on something on the premises that the owner knew about and failed to correct. The most common occurrence is a slip and fall at a grocery or convenient store. Another common source of premises liability claims involve dog bite injuries. A property owner or keeper of an animal may be subject to strict liability for injuries caused by the animal. Liability can include medical bills, lost wages, and pain and suffering.

Occasionally, inadequate security in a building allows criminal activity to occur that results in injury to the building's occupants or customers. Some buildings or premises are required to maintain a certain level of security, and inadequate security that leads to injury can result in liability of the owner to anyone injured or killed.
