If you have been injured and qualify for benefits, you may expect to receive:

  • Temporary total benefits are often referred to as "Section 34 benefits." If your injury or illness leaves you unable to work for six or more full or partial calendar days, you may be entitled to receive 60 percent of your gross average weekly wage. Your gross average weekly wage will be inclusive of any overtime and bonuses you have received in the 52 weeks before your injury occurred. The state does set a maximum weekly wage in October every year. You can receive these benefits for up to 156 weeks. Compensation begins on the sixth day of incapacity; you will not be compensated for the first five days of incapacity unless you are disabled for more than 21 days.
  • Partial incapacity benefits are often referred to as "Section 35 benefits." If your injury allows you to still work but results in you losing part of your earning capacity, because you are forced to change jobs at a lower pay rate or to work fewer hours, you may be entitled to 75 percent of what your total temporary workers' compensation benefits would be. You can receive these benefits for a maximum of 260 weeks.
  • Permanent and total incapacity benefits are often referred to as "Section 34A benefits." If your injuries cause you to be permanently and totally unable to do any kind of work because of your work-related illness or injury, you could be entitled to two-thirds or 66.67 percent of your gross average weekly wage. You are entitled to these benefits as long as you are completely disabled.
  • Medical benefits are available if you suffer a work-related illness or injury that requires medical treatment. You are entitled to adequate and reasonable medical care as well prescription reimbursement and mileage reimbursement for travel related to all of your medical treatment. It is important to note that you are entitled to this variety of workers' compensation benefits for as long as medical services are still required due to your injury or illness.
  • Loss of function/disfigurement benefits can be collected if your injury has resulted in the permanent loss of a specific bodily function. You may also be entitled to this benefit if your injury or illness results in a scar on your face, neck, or hands. A loss of function or disfigurement payment is a one-time payment and is dependent upon the severity of the loss of function and/or scar incurred.
